This service is provided to you by Hyarchis Company Ltd ("Hyarchis"). Your access to all services provided by Hyarchis ("the Services") is conditional upon your acceptance and compliance with the terms, conditions, notices and disclaimers contained in this document (known collectively as "Terms of Use"). Your use of, and/or access to all the Services constitutes your agreement to the Terms of Use. Hyarchis reserves the right to amend the Terms of Use at any time. Since you are bound by these Terms of Use, you should ensure that you have read and fully understood them.

Your telephone carrier supplies the carriage for the Subscription Service to you. The charges for the carriage of the Service will appear on your next mobile telephone bill. All queries relating to mobile telephone bills should be directed to your mobile telephone carrier. Charges for specific Services are set out below.

Under no circumstances (including but not limited to any act or omission on the part of Hyarchis) will Hyarchis be liable for any indirect, incidental, special and/or consequential damages or loss of profits whatsoever which result from any use or access of, or any inability to use or access the Services. You agree to opt in to marketing lists for an indefinite period. Terms can change without notice.

By subscribing to one of our services, you agree that (a) your mobile number can be used for further marketing purposes for an indefinite period by Hyarchis and their business partners, (b) to subscribe to the service described and receive MT messages to your mobile phone at the service rates described below but which subscription can be terminated by you at any time by sending the word STOP to the corresponding short code.

Except as provided for by any non-excludable statutory right:
a) all content for the Services are provided "as is" and without warranties of any kind, either express or implied,
b) Your mobile telephone carrier, Hyarchis and its suppliers expressly disclaim all warranties of any kind including but not limited to implied warranties of merchantability and fitness for a particular purpose,
c) Neither your mobile telephone carrier, nor Hyarchis warrant that access to the Services will be available, uninterrupted, free from delay or error-free or that any defects will be corrected. Your mobile telephone carrier or Hyarchis may terminate or discontinue in whole or in part any or all of the Services at any time, for any reason.
d) You must use the Service in a manner consistent with any and all applicable laws and regulations.
e) The service is open to customers who are connected to the Telstra, Vodafone, Optus, Orange mobile digital networks and participating service providers with Text messaging compatible mobile phones.

Additional Terms & Conditions:
Use of Hyarchis Ringtone Club (1972 6435): This service is a Mobile Content subscription service at $6.60 per MT. Subscribers receive 1 MT message (= 1 credit) per 5 (five) days, allowing 1 download per credit. Additional downloads at additional cost of $6.60 per download.
Use of Hyarchis Ringtone Club (1972 4321): This service is a Mobile Content subscription service at $5 per MT. Subscribers receive 1 MT message (= 1 credit) per 5 (five) days, allowing 1 download per credit. Additional downloads at additional cost of $5 per download.
Use of Hyarchis Ringtone Club (1996 1010): This service is a Mobile Content subscription service at $4 per MT. Subscribers receive 1 MT message (= 1 credit) per 5 (five) days, allowing 1 download per credit. Additional downloads at additional cost of $4 per download.

Please be advised some services are delivered via WAP PUSH.

Customers must not use Hyarchis or generate Hyarchis content:
(a) with the intention or result that another person is menaced or harassed; or
(b) that would be regarded by reasonable persons as being, in all the circumstances, offensive; or
(c) that is indecent, obscene, abusive, threatening, defamatory or incites hatred to any person or groups; or
(d) having regard to any reference in the content to matters of drug misuse or addiction, crime, cruelty, violence, revolting or abhorrent phenomena or obscene language; or
(e) that interferes with the enjoyment of an Hyarchis session by other Customers;
(f) that breaches any laws
(g) infringes a third party's rights (including Intellectual Property Rights and copyright); or
(h) that advertises products or services.
